Terms and Conditions
1. Bookings and Payments
- Bookings must be made in advance through our booking system, social media, email, or by phone.
- To secure the booking, a 50% deposit of the total amount is required. The remaining balance must be paid up to 48 hours before embarkation.
- Last-minute bookings (less than 48 hours before departure) are subject to availability and must be paid in full at the time of booking.
2. Cancellations and Refunds
- Cancellations made more than 10 days before the date of the trip will receive a full refund.
- Cancellations made between 10 and 2 days before the trip will receive a 50% refund of the total trip cost.
- Cancellations made less than 48 hours in advance or no-shows will be charged the full cost of the trip.
- Singular Yacht Charter reserves the right to cancel or alter trips due to safety concerns, adverse weather conditions, or force majeure. In such cases, a new date or a full refund will be offered.
3. Onboard Safety
- Compliance with the captain’s and crew’s instructions is mandatory at all times.
- Swimming, diving, or jumping from the vessel is prohibited without the captain’s express permission.
- Children must always be accompanied by a responsible adult.
- The consumption of illegal substances on board is strictly prohibited.
4. Passenger Behaviour
- Singular Yacht Charter reserves the right to terminate the trip without a refund in the event of abusive, reckless, or dangerous behaviour that compromises the safety of others or the vessel.
- Damages to the vessel or equipment caused by negligence will be charged to the client.
- Smoking is only permitted on the aft platform.
5. Travel Itineraries
- Due to weather conditions, itineraries may need to be altered, and this will not constitute grounds for a refund.
6. Liability and Insurance
- Singular Yacht Charter has all liability insurances required by law.
- The company is not responsible for the loss or damage of personal belongings during the trip. It is recommended not to bring valuables that could fall overboard.
- A liability waiver may be required for certain activities offered as part of our service (SUP, jet ski, diving, etc.).
- Clients must inform the company of any allergies or medical conditions that could affect the trip.
7. Privacy and Personal Data
- Client data is treated confidentially and used solely for booking and communication purposes.
- Singular Yacht Charter is committed to complying with the applicable data protection legislation (GDPR).
8. Images and Advertising
- Photos or videos may be taken during trips for promotional purposes. If you do not consent to the use of your image, please notify us in writing in advance.
9. Governing Law and Jurisdiction
- These Terms and Conditions are governed by Portuguese law.
- For any arising disputes, the court of the Comarca of Funchal will have jurisdiction, with express waiver of any other.
